Toliccs Terms of Service

These Terms govern your use of toliccs.com.au, shop.toliccs.com.au and any related Toliccs services (the "Site"), and the supply of goods by Toliccs ("we", "us") to you ("you", "the customer"). By placing an order or using the Site you accept these Terms.

1. About us

"Toliccs" is a registered business name (active from 19 March 2023) of The Trustee for Auto Body Supplies Unit Trust (Fixed Unit Trust, ABN 98 851 166 139), administered by Nicbar Nominees Pty Ltd as trustee. Trading address: 9 Burgay Court, Osborne Park WA 6017. Toliccs is an Australian wholesale distributor of workshop and lubrication supplies. All sales are subject to acceptance by us and to these Terms.

2. Orders and acceptance

Your online order is an offer to purchase. We accept the offer when we email order confirmation and despatch. We may reject any order at our discretion — for example, where stock is unavailable, pricing has been mis-displayed, or where credit terms are not met.

3. Pricing and GST

All prices are quoted in Australian Dollars (AUD). Prices are exclusive of GST unless explicitly stated. GST at the prevailing rate (currently 10%) is added at checkout for Australian deliveries. Trade-account pricing supersedes website pricing where a written agreement is in place.

4. Payment

Standard customers pay at checkout via the available payment methods. Trade-account customers with approved terms are invoiced and pay on agreed terms (typically 30 days from end of month). Overdue accounts may be placed on stop-supply and incur interest at the rate prescribed by the Penalty Interest Rates Act 1983.

5. Stock and availability

We endeavour to display accurate stock levels. Where a line is out of stock at the time of pick, we will contact you to confirm a delay, substitute or refund. Specials and clearance lines are subject to prior sale.

6. Delivery

Delivery times are estimates. Risk in the goods passes to you on despatch. Title remains with us until the goods are paid for in full. See our Shipping & Delivery page for carrier and ETA information.

7. Warranty

Manufacturer warranties pass through to the end customer. Our goods come with statutory guarantees under Australian Consumer Law that cannot be excluded — see our Refund Policy for details.

8. Use of goods

Lubricants, additives and workshop chemicals must be used in accordance with the manufacturer's specifications and the Safety Data Sheet supplied with the product. We are not liable for damage arising from use outside specification.

9. Intellectual property

All content on the Site (excluding manufacturer brand assets used under licence) is owned by Toliccs or its licensors. Reproduction for commercial purposes without written consent is prohibited.

11. Limitation of liability

To the extent permitted by law, our liability for any breach of these Terms is limited to (at our election) the replacement of the goods, the supply of equivalent goods, or the refund of the purchase price. Nothing in these Terms limits any rights you have under Australian Consumer Law.

12. Governing law

These Terms are governed by the laws of Western Australia and the parties submit to the non-exclusive jurisdiction of the courts of Western Australia.
